  • COACHIFY may modify the algorithm used to calculate your test score, which may similarly result in a retrospective revision of your scores

COACHIFY disclaims all liability with respect to the misuse, loss, modification, or unavailability of any content.

Indemnification and Limitation of Liability

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS COACHIFY, INCLUDING BUT NOT LIMITED TO ITS AFFILIATE VENDORS, AGENTS, OFFICERS, DIRECTORS, EMPLOYEES, AND PARTNERS, FROM AND AGAINST ANY AND ALL LOSSES, LIABILITIES, CLAIMS, DAMAGES, DEMANDS, COSTS, AND EXPENSES (INCLUDING LEGAL FEES AND DISBURSEMENTS) ARISING OUT OF OR IN CONNECTION WITH:

Limited Time to Bring Your Claim

You and COACHIFY agree that any cause of action arising out of or related to the Website or its services must be commenced within one (1) year after the cause of action first accrues. Upon the expiry of this period, such cause of action shall be permanently and irrevocably barred, with no exceptions.

Disputes and Jurisdiction

We believe that the vast majority of concerns can be addressed through open and honest communication. If you have a grievance, we encourage you to first write to us at contact@coachifylive.com and give us the opportunity to resolve it directly.

In the event a dispute cannot be resolved informally, all disputes arising out of or relating to these Terms —including those involving rights conferred, compensation, refunds, and any other claims — shall be resolved through a two-stage Alternate Dispute Resolution mechanism:

  • Stage 1 — Mediation: The matter shall first be referred to a sole mediator, who shall be a neutral third party selected by mutual agreement. In the event the parties are unable to agree on a mediator, COACHIFY reserves the right to determine who the mediator shall be. The mediator's decision shall not be strictly binding; however, both parties shall endeavour in good faith to abide by it.
  • Stage 2 — Arbitration: If mediation does not yield a mutually acceptable resolution, the matter shall proceed to arbitration conducted by a Sole Arbitrator appointed by COACHIFY. The award of the Sole Arbitrator shall be final and binding on both parties, and no further legal remedy shall be available. Arbitration proceedings shall be conducted in the English language and shall be seated in Jaipur, Rajasthan.

In the event that the dispute resolution mechanism fails, the matter shall be governed by the laws of India, and the courts of Jaipur, Rajasthan shall have exclusive jurisdiction.

Content Liability

COACHIFY shall not be held responsible for any content appearing on third-party websites that link to or from this Website. You agree to protect and defend COACHIFY against all claims arising in connection with content on any external website linked to or from the Website.

Reservation of Rights

COACHIFY reserves the right, at any time and at its sole discretion, to request the removal of any links to the Website, amend these Terms and its policies, or withdraw access to the Website or any part thereof. Your continued use of the Website or maintenance of any links to it shall constitute acceptance of any such changes.

Aagman — Tie-Breaking Rule

In the event that two or more participants achieve identical scores in any quiz, contest, or assessment on the platform, priority shall be awarded to the participant who submitted their response first, based on the server timestamp at the time of submission. COACHIFY's decision in all such matters shall be final and binding.

Grievance Redressal

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Subject to the dispute resolution mechanism described above, all disputes shall be subject to the exclusive jurisdiction of the courts at Jaipur, Rajasthan.

Disclaimer

To the maximum extent permitted by applicable law, COACHIFY excludes all representations, warranties, and conditions relating to this Website and its use. Nothing in this disclaimer shall limit or exclude liability for death, personal injury caused by negligence, or fraud. Subject to the foregoing, all liabilities arising under or in connection with these Terms — whether in contract, tort, or breach of statutory duty — are governed by the limitations set out in this document.
